1. REGISTRATION IN THE TRADE REGISTRY

Application for registration of entrepreneur-individual in the commercial register submits an individual to be registered as an entrepreneur-individual or his representative with special power of attorney in which there is data that are recorded in the Trade Registry.

2. DATA

The application for registration shall state:

1) name and surname, personal identification number of the citizen (hereinafter: the ID number) and place of residence;

2) the company under which the activity is performed;

3) the headquarters and

4) subject of the work.

3. ATTACHMENTS

To the application for registration are attached:

1) notarized signature of the entrepreneur-individual;

2) statement of the individual that he has not been imposed a prohibition to carry out any of the activities specified in this law and

3) statement of the individual that have duly paid the tax liabilities and retirement, disability and health insurance, i.e. in accordance with Article 29 of the Company Law, there is no obstacle to acquire the status of an entrepreneur-individual.

4) One individual registered as an entrepreneur-individual cannot, simultaneously, on any basis, be registered as an entrepreneur-individual under another firm.

4. RESTRICTIONS

An individual cannot be registered as an entrepreneur-individual when there is:

1) bankruptcy;

2) by a court decision, has determined that intentionally caused the bankruptcy, because creditors could not collect their claims during the prohibition of the activity determined by the court’s decision and

3) by a competent authority, on the bases of a law, it is forbidden to carry out any of the activities specified in this law during the prohibition.

5. TRANSFER OF COMPANY

- Transferring of the company is registered in the Trade register.

Attachments

Towards the application for registration of the transfer of company shall be attached:

1) agreement for the transfer of the firm certified by a notary and

2) evidence that all the creditors have agreed to the transfer of the company, unless any creditor with a submission before the court countered the transmission of the firm.

6. APPLICATION FOR DELETING ENTRIES

Entrepreneur-individual submits an application for deleting the entry of the entrepreneur-individual in the trade registry.

Attachments

1) statement for the termination of the entrepreneur-individual;

2) proof that the account of the entrepreneur-individual is closed and

3) proof that the entrepreneur-individual duly paid the tax liabilities and retirement, disability and health insurance and the employment contribution.

(3) The attribute of an entrepreneur-individual stops deleting entry of the entrepreneur-individual in the commercial register.
